Collin County District Attorney to re-try Schlosser case

(McKinney, TX) – Collin County District Attorney John Roach announced today that his office will re-try Dena Schlosser for the murder of her 10-month-old daughter, Margaret (Maggie). The first trial ended in a hung jury after almost two weeks of testimony and three days of jury deliberations.

“There is no dispute that Dena Schlosser killed her daughter. The question is whether Mrs. Schlosser was insane at that very time,” says Mr. Roach. “The issue of insanity should always be decided by a judge or a jury based on the law and the evidence admitted at trial, not by the DA. Unfortunately, the jury could not reach a unanimous verdict as whether Mrs. Schlosser was guilty of murder, or not guilty by reason of insanity.”

Mr. Roach stated that at a pretrial hearing scheduled for this Wednesday, the State will waive its right to a jury trial and ask the trial judge to decide the case based on the evidence the judge heard at the first trial. The State will also ask the judge to allow both the defense and the State an opportunity to present any additional evidence and to once again make final arguments.

“The issue now is whether Dena Schlosser and her attorneys will waive her right to a jury trial. If she does, the case will be submitted to the judge without a jury. If she does not waive her right to a jury trial, there will be no other choice but a full-blown jury trial. We are ready whatever their choice,” says Mr. Roach.
