County Court at Law #3
Due to Covid-19 concerns, the Court is willing to waive both the appearance of the attorney and the Defendant at first appearance dates under the following circumstances:
The Assistant District Attorney assigned to the court will send to the attorney upon request a waiver of appearance form to be signed by the attorney verifying receipt of the discovery, verifying the receipt of a plea offer, verifying a plea date, and verifying that the offer and plea date have been shared with the Defendant. ALL LINES MUST BE INITIALED TO HAVE THE WAIVER ACCEPTED AND CASE OR CASES PASSED.
If the waiver of appearance form is not sent to the coordinator by
NOON on the day before the first appearance, the attorney and defendant must appear. Defendant should wait in his or her car in the parking lot and text their name
214-901-7293 to check in with The Court. They should wait there until they are released by The Court and their attorney.
On the plea date, both the Defendant and attorney must appear and check in with The Court by texting their name to 214-901-7293 from their vehicle. The Court will then instruct them when they are to come into the courthouse, and they should proceed directly to the courtroom where the case is pending. All Plea paperwork must be efiled by
NOON the day before the plea date.
If you choose to Plea via Zoom, plea paperwork must be efiled by
NOON the day before the plea. An email must be sent to the coordinator or bailiff with the correct email addresses to be used by the attorney and defendant for the Zoom Plea. Once the plea has been completed, the defendant will need to come to the courthouse to complete the process. A timeframe will be given during the Zoom Plea on when they should appear. When they get to the parking lot, they should text 214-901-7293 with their name. The Court will then text them back when it is their turn to come in to take care of their paperwork.
Those who fail to appear will be subject to Bond Forfeiture.
Pro Se (self-represented) defendants will need to come to the courtroom. Defendant and attorney must wear face coverings while in the courthouse at all times. Attorneys and parties should maintain safe distances from one another at all times.
Obviously, anyone with fever or not feeling well should stay out of the courthouse.
