Assumed Names

​​​​​​​Texas Business and Commerce Code Title 5 Chapter 71.051 requires persons conducting business or providing professional services to file an Unincorporated Assumed Name Certificate in the County in which the person(s) will be conducting their business. Please use the following guidelines when applying for an Assumed Name in Collin County:

  • Unincorporated Assumed Names may be filed in the County Clerk's main office located in the Jack Hatchell Administration Building or at our Plano location. After completing the online application, please visit our McKinney or Plano location to complete the filing of your assumed name or abandonment of assumed name.

  • If you have partners in an unincorporated business, each person must be present to sign the Assumed Name document at the time of filing.

  • Your Assumed Name must be filed with the County Clerk unless you are required to file with the Secretary of State. For more information on state requirements please visit the Secretary of State's Name Filing FAQs.

  • If filing by mail, your application must be notarized.

  • Assumed Name Certificates are valid for 10 years from date of issue.

  • You may file more than one Assumed Name.

  • Assumed Name Certificates may have more than one registrant.

  • There is no age requirement for filing an Assumed Name.

If you mail your application and pay by check, you must include a legible copy of your valid government issued photo ID with your notarized application.

Important Note: Many businesses are required to obtain a sales and tax permit to sell their product. To find out if this requirement applies to your business, please call the State Comptroller at (800) 252-5555.


Assumed Name Search

Searching an Assumed Name business may be conducted in person, online or by mail. We DO NOT accept telephone requests for business name searches. Business name searches can be conducted in person at the County Clerk's Office free of charge, at the time of filing.

​​Assumed Name - Online Application​​

After applying online, to complete the transaction all parties must appear in our office within 10 calendar days from the date the application is submitted. If necessary, you may reapply in our office.

Search by Mail

Searches by mail can be ordered by sending a written request to:

The request should include the name and address of the business. The search fee is $10 per name and includes a copy of the certificate. A check or money order, payable to the County Clerk, must accompany the written request. The search fee is non-refundable. A "No Record Statement" will be issued if a record is not found.

Moving Your Business Out of the County

If you move your business out of Collin County, you have two (2) options: (1) you can let the Assumed Name expire, or (2) you can file a Statement of Abandonment for a filing fee of $18.50 for one owner, plus $1 for each additional owner.

Fees:

  • $18.50 to file an Assumed Name Certificate for an unincorporated business; $1.00 extra for each additional owner.
  • $19.50 to file an Assumed Name Certificate for a corporation, unless Registered Agent and the one signing is different. If so, there is an additional $1.00 for each additional owner or registered agent.
  • There is a copy fee of $1.00 per page plus an additional $5.00 for a certified copy.
  • Please refer to the County Clerk's fee schedule for recording fee for documents signed in front of a Notary Public.

Abandonment Fee:

  • $18.50 to file a Statement of Abandonment for an unincorporated business; $1.00 extra for each additional owner.
  • $19.50 to file a Statement of Abandonment for a corporation, unless Registered Agent and the one signing is different. If so, there is an additional $1.00 for each additional owner or registered agent.
  • There is a copy fee of $1.00 per page plus an additional $5.00 for a certified copy.
  • Please refer to the County Clerk's fee schedule for recording fee for documents signed in front of a Notary Public.
