"A judge shall not initiate, permit, or consider ex parte or other communications made to the judge outside the presence of the parties... concerning the merits of a pending or impending judicial proceeding. A judge shall require compliance with this subsection by court personnel subject to his or her direction and control..." Code of Judicial Conduct, Canon 3, Section B. (8).
The Justice of the Peace's primary function is to hold civil court both justice and small claims as quickly and judiciously as possible to relieve the caseload of the higher courts. In addition to these functions the court has criminal jurisdiction of such cases as bad checks, truancy, some traffic offenses, issue peace bonds and hold hearings on the same. The Justice of the Peace Court in Texas performs magisterial duties such as accepting criminal complaints, ordering arrests, issuing search warrants, conducting examining trials and appointing legal counsel. The State of Texas now has a new program available that is as easy as 1, 2, 3 to assist filers in filling out their documents. Guide and File is a program designed to help users maneuver step-by-step through the information needed to generate forms that are required to initiate a cause of action.
This program is free of charge and works similar to TurboTax. The user is guided through an array of questions and upon completion the answers are populated onto the proper filing form. At this point they are given the option to either E-file the forms or print them off and bring them to the appropriate Justice of the Peace office. Guide and File has forms available for filing an Eviction, Small Claims, Repair and Remedy and an Occupational Driver License.
